Court annuls Malami’s unilateral reform to the professional regime of lawyers (DOWNLOAD SENTENCE)

The Abuja Federal High Court, on August 10, annulled the unilateral amendment of the Rules of Professional Conduct (RPC) for legal professionals in Nigeria by the Attorney General of the Federation (AGF), Abubakar Malami. the Nigerian Bar Association (NBA), through its former vice president, Monday Ubani, filed the lawsuit challenging the modification of the Rules of Professional Conduct (RPC) for lawyers by Mr. Malami. In 2020, Malami single-handedly amended the provisions of the Rules of Professional Conduct (RPC), removing the mandatory use of the NBA seal and seal for attorneys. It also removed provisions that require lawyers acting for the government, ministries or corporations to pay annual fees for practicing law. The seal and seal, according to the rules, must be affixed to any document signed by attorneys in order for said document to receive an acknowledgment with attorney’s imprimatur. At his trial in the NBA lawsuit, the judge, Donatus Okorowo, declared the AGF’s rule amendment to be “illegal and invalid.” He stated that only the General Council of Lawyers, which has the power to reform the Regulation of Professional Conduct (RPC), is made up of several members, so the regulation cannot be legitimately reformed by the will and singular action of an individual.
