Life sentence for cleric for raping a neighbor’s daughter

A Ikeja Domestic Violence and Sex Crimes Courton Tuesday, he sentenced a 50-year-old cleric, Isa Mustapha, to life in prison for raping his neighbor’s eight-year-old daughter. The Nigerian News Agency (NAN) reports that Mr. Mustapha is accused of corruption. Upon sentencing, Judge Ramón Oshodi held that the prosecution had successfully tested the ingredients of desecration against the convict. “In desecration, the consent of the survivor is irrelevant as a child cannot consent. I believe the evidence of the survivor’s father when he said that she was eight years old when the incident occurred. “The prosecution has successfully tested the first ingredient of desecration. “The survivor, who identified the defendant as “Alpha” who lives downstairs from her house, stated that her mother sent her on an errand to buy peppers in which the defendant told her to bring her onions. “On his way back to his house, he lured her into his room. “The survivor told this court that the defendant slept with her four times and that the defendant lives alone in his apartment. “The survivor’s testimony was impeccably clear as there was no inconsistency in her evidence. The judge said that the defendant’s oral presentation, the medical report and the investigating police officer corroborated the evidence in court. “Defendant’s oral admission that he was at the scene of the incident and only touched the survivor corroborated the evidence in court that the defendant was with the survivor at the scene of the incident. “The defendant is hereby found guilty as charged. He is sentenced to life in prison,” Oshodi maintained. The judge ordered that the convict’s name be entered on the Lagos State sex offenders register. Earlier, the defense attorney, Morenike Ifarinde, asked the court to moderate justice with leniency, adding that the defendant was an “alpha” and had never been charged with any crime. “We urge the court to give the accused a minimum sentence after he has been convicted,” said Ms. Ifarinde. However, the Babajide Boye and Abiodun Alagbe team of state prosecutors urged the court to sentence the accused accordingly. “My lord, the crime of desecration is widespread in our society. This will serve as a clear message to the public that the state government will not tolerate a situation where children cannot move freely without fear of sexual assault. “We urge my lord to convict the defendant accordingly,” the prosecution filed. NAN reports that the prosecution presented four witnesses and four pieces of evidence during the convicted man’s trial. The offense contravened Section 137 of the Lagos State Penal Laws, 2015.
