PPD spokesperson prosecuted for criticizing federal legislator on Facebook

The spokesman for the Peoples’ Democratic Party (PDP) in Ebonyi state, Chika Nwoba was prosecuted in a magistrate court in Abakaliki, the state capital, for allegedly posting false, malicious and defamatory material on Facebook against a federal lawmaker in the state. Lawmaker Chinedu Ogah represents the Ikwo/Ezza South federal constituency in the House of Representatives. This is the second time Nwoba has been prosecuted in two days. He was indicted on Wednesday, accused of posting false information on Facebook against Ebonyi State Governor Dave Umahi. For Thursday’s case, Nwoba is accused of portraying the federal lawmaker as unable to stand in the House of Representatives. The prosecution said the alleged posts portrayed Ogah as “greedy and corrupt, terrorist, land grabber, cheater, timid and unachieved”. After Mr. Nwoba’s six-count indictment was read out, his lawyer, Luke Nkwegu, urged the court to dismiss the charges against his client. He said that the charges were brought against Mr. Nwoba by the police in bad faith to keep him behind bars. Mr. Nkwegu argued that the state’s Cybercrime Prohibition Act, under which Mr. Nwoba was being tried, was not published. An unofficial law, said the lawyer, was not a law. Chinedu Ogah He prayed that the court would grant his client bail. But the police prosecutor, Mathias Eze, opposed Nkwegu. He urged the court to arrest Mr. Nwoba. “We hold that the validity of a law enacted by an act of parliament, whatever it may be, is determined by the consent of the governor or president,” he told the court. The magistrate, Blessing Chukwu, said the court lacked jurisdiction to hear the matter and ordered that Mr. Nwoka be taken into police custody in accordance with Covid-19 protocol. He ordered that the case file be forwarded to the State Attorney General’s Office, Public Ministry. The case was adjourned until February 4.
